B.A.A.R. intends to become part of the protocol of cooperation regarding the amicable report
Discussions about changing the protocol of cooperation regarding the amicable report and the correspondent legislation, remaines a current issue. The specialists consider that, to the extent it will be needed and depending on the feedback received about the way the amicable report had functioned so far, the necessary improvements will be made.
"Currently, B.A.A.R. expressed the intention of becoming part of the protocol, as the legal representative of insurers from abroad, according to art. 54 para. (2) of Law no. 136/1995. For now, though, we have no proposals to change the protocol", said Mariana GARBAN, Secretary General, Romanian Bureau of Motor Insurers (B.A.A.R.).
On April 9, 2009, representatives of insurance companies that sell MTPL have signed, at the ISC headquarters, the protocol of cooperation regarding the amicable report in case of accident.
This provides the criteria for determining liability in case of accidents, the probation system and instructions for the implementation of the cases. This casuistry describes all the possibilities of collision that may occur in traffic, as well as the way of establishing civil liability in the event.
